يعين رئيس مجلس الدولة بقرار من رئيس الجمهورية
من بين نواب رئيس المجلس بعد أخذ رأى المجلس الأعلى للهيئات القضائية
ويعين نواب رئيس المجلس بقرار من رئيس الجمهورية بناء على ترشيح
الجمعية العمومية للمجلس وبعد أخذ رأى المجلس الأعلى للهيئات القضائية .
ويعين باقى الأعضاء والمندوبون المساعدون بقرار من رئيس الجمهورية
بعد موافقة المجلس الأعلى للهيئات القضائية .
ويعتبر تاريخ الترقية من وقت موافقة المجلس الأعلى للهيئات القضائية .
