للمحكمة أن تقيم الدعوى على عاملين من غير من قدموا
للمحاكمة أمامها إذا قامت لديها أسباب جدية بوقوع مخالفة منهم ، وفى
هذه الحالة يجب منحهم أجلا مناسبا لتحضير دفاعهم إذا طلبوا ذلك ،
وتحال الدعوى برمتها إلى دائرة أخرى بقرار من رئيس مجلس الدولة بناء على
طلب رئيس المحكمة .
