لخمسين عضوا على الأقل ممن حضروا الجمعية العمومية الطعن فى صحة انعقادها أو فى تشكيل مجلس النقابة ، بتقرير موقع عليه منهم يقدم إلى قلم كتاب محكمة النقض خلال ١٥ يوما من تاريخ انعقادها ، بشرط التصديق على التوقيعات من الجهة المختصة ، ويجب أن يكون الطعن مسببا ، وإلا كان غير مقبول شكلا .
