إذا خلا مركز النقيب لأى سبب ، حل محله الوكيل إلى أن تنتخب الجمعية العمومية فى أول اجتماع لاحق له . وإذا [غير مقروء] خلا مركز أحد أعضاء المجلس ، حل محله من حاز أكثر الأصوات بعد آخر من انتخب لعضوية المجلس فى الانتخابات السابقة من نفس تمثيله النقابى وفى حالة الانتخاب بالتزكية يفتح باب الترشيح لانتخاب من يحل محله .
