تؤلف محكمة النقض من رئيس وعدد كاف من نواب الرئيس والمستشارين
وتكون بها دوائر لنظر المواد الجنائية ودوائر لنظر المواد المدنية والتجارية
والأحوال الشخصية والمواد الأخرى ، ويرأس كل دائرة فيها رئيس المحكمة
أو أحد نوابه ، ويجوز عند الاقتضاء أن يرأس الدائرة أقدم المستشارين بها .
وتصدر الأحكام من خمسة مستشارين .
