إذا قام مانع لدى رئيس اللجنة العليا يحل محله أقدم رؤساء محاكم الاستئناف .
وإذا قام مانع لدى أحد أعضاء اللجنة العليا حل محله العضو الاحتياطى الذى رشحه
المجلس الأعلى للجهة التى يعمل بها .
وفى جميع الأحوال يكون الحلول طوال مدة قيام المانع ، وفى هذه الحالة يختار المجلس الأعلى
للجهة القضائية التى يتبعها هذا العضو عضوا احتياطيا آخر .
