تقدم الاستقالة من عضوية المجلس الشعبى المحلى الى رئيسه ويجب عليه عرضها على المجلس فى أول جلسة تالية لتقديمها وتعتبر الاستقالة مقبولة بموافقة المجلس عليها وفى هذه الحالة يقرر المجلس خلو المحل ويخطر رئيس المجلس المحافظ بخلو المحل.
