ينتخب المجلس الشعبى المحلى من بين أعضائه فى أول اجتماع لدور انعقاده العادى ولمدة هذا الدور رئيسا ووكيلا له على أن يكون أحدهما على الأقل من العمال أو الفلاحين.
ويحل الوكيل محل رئيس المجلس عند غيابه، واذا غاب الرئيس والوكيل تكون الرئاسة لأكبر الأعضاء سنا، واذا خلا مكان أحدهما انتخب المجلس من يحل محله الى نهاية مدته.
