يكون لكل وحدة من وحدات الحكم المحلى مجلس شعبى محلى من أعضاء منتخبين انتخابا مباشرا، ويكون نصف عدد الأعضاء على الأقل من العمال والفلاحين وذلك طبقا لتعريف العامل والفلاح المعمول به بالنسبة لأعضاء مجلس الشعب، ويشترط أن يكون من بين أعضاء المجلس عنصر من النساء على النحو الموضح بهذا القانون.
ويمثل المجلس الشعبى المحلى رئيسه أمام القضاء وفى مواجهة الغير.
