يقسم المحكوم عليهم إلى درجات لا تقل عن ثلاث .
وتبين كيفية المعاملة والمعيشة لكل درجة بقرار من وزير الداخلية بناء على اقتراح مدير عام السجون وموافقة النائب العام .
وتراعى اللوائح الداخلية للسجون فى ترتيب وضع المسجونين فى كل درجة وفى نقلهم من درجة إلى أخرى مع مراعاة السن .
