يختص مجلس النقابة وحده بالفصل نهائيا فى التظلمات التى يقدمها ذوو الشأن أو أحد أعضاء لجنة الصندوق من قرارات لجنة الصندوق وتقدم التظلمات خلال ثلاثين يوما من تاريخ إخطار ذوى الشأن بقرارات اللجنة .
ويجب على المجلس قبل الفصل فى التظلم أو سماع أقوال ذوى الشأن إذا كان التظلم من أحد أعضاء لجنة الصندوق أو أقوال أمين الصندوق إذا كان التظلم من ذوى الشأن .
