إذا حكم بقبول الطعن المشار إليه في المادة السابقة بطلب قرارات الجمعية العمومية وأعيدت دعوتها إلى الاجتماع في مدى ثلاثين يوما من تاريخ قبول الطعن .
وتدعى كذلك في حالة الحكم ببطلان عملية الانتخاب بالنسبة للنقيب أو خمسة فأكثر من أعضاء مجلس النقابة في مدة لا تتجاوز ثلاثين يوما من تاريخ الحكم بالبطلان ، فإذا كان عدد من أبطل انتخابه أقل من ذلك حل محله من حاز أكثر الأصوات بعده في الانتخاب .
