إذا لم يحضر المدعى عليه رغم تكليفه بالحضور ولم يرسل محاميا ينوب عنه تنظر محكمة الدعوى وتحكم فيها في غيبته.
ويجوز للمحكمة أن تلزم المدعى عليه بالحضور أمامها ولها في سبيل ذلك أن تأمر بضبطه وإحضاره.(3)
