يحق للنقابة الاستفادة من نظام التفرغ بالاستعانة بتفرغ ثلاثة على الأكثر من أعضائها المشتغلين بالمؤسسات والهيئات العامة ولمدة ثلاث سنوات متتالية على الأكثر .
كما يحق اتباع نفس النظام لشخص واحد لكل فرع من فروع النقابة بالمحافظات .
