يتجاوز عن استرداد المبالغ التى صرفت بالمخالفة لأحكام حظر الجمع بين المعاشات أو بين المعاش والدخل، وذلك فى الحدود التى يجيز فيها قانون التأمين الاجتماعى الصادر بالقانون رقم 79 لسنة 1975 معدلا بأحكام القانون رقم 14 لسنة 1991 الجمع بين معاشين أو بين المعاش والدخل، ويصدر وزير التأمينات قرارا بقواعد تنظيم هذا الحكم.
