يجب أن يكون اتفاق التحكيم مكتوبا وإلا كان باطلا . ويكون اتفاق التحكيم مكتوبا إذا تضمنه محرر وقعه الطرفان أو إذا تضمنه ما تبادله الطرفان من رسائل أو برقيات أو غيرها من وسائل الاتصال المكتوبة .
