يجوز فى الأحوال الخاصة تشكيل المحكمة العسكرية العليا من خمسة ضباط ، والمحكمة العسكرية المركزية لها سلطة العليا والمحكمة المركزية من ثلاثة ضباط .
ويكون ذلك بقرار من الضابط الآمر بالإحالة .
