تباشر النيابة العسكرية التحقيق فى الجرائم الآتية فور إبلاغها إليها :
١ كافة جرائم القانون العام الداخلة فى اختصاص القضاء العسكرى .
٢ كل الجرائم العسكرية الموسطة بجرائم القانون العام .
٣ الجرائم العسكرية المحالة إليها من السلطات المختصة طبقا للقانون .
وعلى النيابة العسكرية إخطار السلطات العسكرية المختصة بقرار التصرف فى التحقيق .
