لعضو الضبط القضائى العسكرى فى حالة الجناية أو الجنحة المتلبس بها أن يفتش أى شخص أيا كان يشتبه فيه بأنه فاعل جرم أو شريك أو حائز لأشياء تتعلق بالجرم أو عفيا شخصا له علاقة بالجريمة . وله أن يضبط
الأشياء والأوراق التى تفيد فى كشف الحقيقة إذا اتضح له من أمارات قوية أنها موجودة معه .
وفى غير ذلك يجب عليه أن يستصدر الأمر بالتفتيش من النيابة العسكرية .
