تنفذ أحكام المحاكم العسكرية بناء على طلب النيابة العسكرية بمعرفة وحدة المتهم أو الشرطة العسكرية وفقا لأحكام هذا القانون .
أما بالنسبة للدنيين فتتولى النيابة العسكرية تنفيذها وفقا للقانون العام .
