لا يجوز لغير المصرى الذى اكتسب ملكية عقار وفقا لأحكام هذا القانون أن يتصرف فيه بأى وجه من وجوه التصرفات الناقلة للملكية قبل مضى خمس سنوات من تاريخ اكتساب الملكية.
ومع ذلك يجوز لرئيس مجلس الوزراء فى الحالات التى يقدرها الإذن بالتصرف فى العقار قبل مضى هذه المدة.
