لا يجوز احالة الدعوى الجنائية الى المحكمة فى الجرائم المشار اليها فى المواد 116 مكررا و116 مكررا ( أ ) و116 مكررا (ب) من قانون العقوبات بالنسبة الى أعضاء مجالس ادارة الشركات الخاضعة لأحكام هذا القانون الا بناء على أمر من النائب العام أو من النائب العام المساعد أو من المحامى العام الأول.
