لا ينتهي إيجار الأراضي الزراعية إذا جند المستأجر أو استدعى للخدمة في القوات المسلحة .
ويجوز للمستأجر في هذه الحالة أن يؤجر الأرض إلى الغير خلال مدة تجنيده أو استدعائه للخدمة على أن ينتهي عقد الإيجار من الباطن بنهاية السنة الزراعية التي تنتهي فيها مدة التجنيد أو الاستدعاء .
ويسرى حكم الفقرة السابقة على مالك الأرض الزراعية التي يؤجر أرضه بسبب تجنيده أو استدعائه للخدمة في القوات المسلحة.
