للمحكمة إذا قضت بالإدانة على أحد الموظفين العموميين ، لارتكابه جريمة من الجرائم المنصوص عليها فى هذا القانون ، أثناء وبسبب تأديته لوظيفته ، أن تقضى بعزله من وظيفته مؤقتا ، إلا فى الحالات المشار إليها فى المادة (٣٤) من هذا القانون فيكون العزل وجوبيا .
