إذا خالف أحد الحاضرين أمر مأمور الضبط القضائي وفقا للمادة ٣٥ من هذا القانون، أو امتنع أحد ممن دعاهم عن الحضور، يذكر ذلك في المحضر، وللنيابة العامة أن تصدر أمرا جنائيا بتغريم المخالف بغرامة لا تقل عن خمسمائة جنيه ولا تزيد على ألف جنيه.
