يرفع الاستئناف أمام محكمة الجنح المستأنفة منعقدة في غرفة المشورة إذا كان الأمر المستأنف صادرا من القاضي الجزئي بالحبس الاحتياطي أو بمده أو بالإفراج، فإذا كان الأمر صادرا من تلك المحكمة، يرفع الاستئناف إلى محكمة جنايات أول درجة منعقدة في غرفة المشورة، وإذا كان صادرا من محكمة جنايات أول درجة يرفع الاستئناف إلى محكمة الجنايات المستأنفة.
