يكون ميعاد استئناف النيابة العامة لأمر الإفراج المؤقت أربعا وعشرين ساعة من تاريخ صدوره، ويجب الفصل في الاستئناف خلال ثمان وأربعين ساعة من تاريخ رفعه.
ويكون استئناف المتهم لأمر الحبس أو مد مدته في أي وقت، فإذا صدر قرار برفض استئنافه جاز له أن يتقدم باستئناف جديد على ذات القرار كلما انقضت مدة ثلاثين يوما من تاريخ صدور قرار رفض الاستئناف.
