يجوز لمحكمة الجنايات المستأنفة، وللدائرة الجنائية بمحكمة النقض عند نظر الموضوع، إقامة الدعوى الجنائية، طبقا لما هو مقرر بالمادة ١٣ من هذا القانون.
وإذا طعن في الحكم الذي يصدر في الدعوى المقامة منها، فلا يجوز أن يشترك في نظرها أحد القضاة الذين قرروا إقامتها.
