١ - يجب أن يكون عقد نقل التكنولوجيا مكتوبا وإلا كان باطلا .
٢ - ويجب أن يشتمل العقد على بيان عناصر المعرفة وتوابعها التى تنقل
إلى مستورد التكنولوجيا . ويجوز أن يرد ذكر هذا البيان مصحوبا بدراسات الجدوى
والتعليمات والتصميمات والرسومات الهندسية والخرائط والصور وبرامج الحاسب الآلى
وغيرها من الوثائق الموضحة للمعرفة فى ملاحق ترفق بالعقد وتعتبر جزءا منه .
