يجوز لأمين التفليسة بعد استئذان قاضى التفليسة أن يطالب الشركاء بدفع الباقى من حصصهم في رأس المال ولو لم يحل ميعاد استحقاقه ، ولقاضى التفليسة أن يأمر بقصر هذه المطالبة على القدر اللازم لوفاء ديون الشركة .
