١ - يؤخذ رأى الدائنين خلال الاجتماع المنصوص عليه فى المادة السابقة فى أمر
تقرير إعانة من أموال التفليسة للمفلس أو لمن يعولهم .
٢ - إذا وافقت أغلبية الدائنين الحاضرين على تقرير الإعانة للمفلس أو لمن
يعولهم وجب على قاضى التفليسة ، بعد أخذ رأى أمين الاتحاد ورأى المراقب ، تعيين
مقدار الإعانة .
٣ - ويجوز لأمين الاتحاد ، دون غيره ، الطعن أمام المحكمة فى قرار قاضى
التفليسة بتعيين مقدار الإعانة ، وفى هذه الحالة بصرف نصف الإعانة لمن تقررت له
إلى حين الفصل فى الطعن .
