١ - يبطل الصلح إذا صدر بعد التصديق عليه حكم بإدانة المفلس فى إحدى جرائم
الإفلاس بالتدليس .
٢ - وكذلك يبطل الصلح إذا ظهر بعد التصديق عليه تدليس ناشئ عن إخفاء
موجودات المفلس أو المبالغة فى ديونه ، وفى هذه الحالة يجب أن يكون طلب إبطال
الصلح خلال ستة أشهر من اليوم الذى يظهر فيه التدليس وإلا كان الطلب غير مقبول .
وفى جميع الأحوال لا يكون طلب إبطال الصلح مقبولا إذا قدم بعد انقضاء سنتين
من تاريخ التصديق على الصلح .
٣ - يترتب على إبطال الصلح براءة ذمة الكفيل الذى يضمن تنفيذ شروطه .
٤ - تختص المحكمة التى أصدرت حكم شهر الإفلاس بنظر دعوى إبطال
الصلح .
