إذا فقد شخص حيازة شيك للحامل أو قابل للتظهير فلا يلزم من آل إليه هذا الشيك بالتخلى عنه إلا إذا كان قد حصل عليه بسوء نية أو ارتكب فى سبيل الحصول عليه خطأ جسيما وبشرط - فى حالة الشيك القابل للتظهير - أن يثبت حقه فيه طبقا لأحكام المادة ٤٩١ من هذا القانون .
