١ - لاتعتبر كفالة الدين التجارى عملا تجاريا إلا إذا نص القانون على ذلك أو كان
الكفيل بنكا أو كان تاجرا وله مصلحة فى الدين المكفول .
٢ - لايجوز فى الكفالة التجارية أن يطلب الكفيل - ولو كان غير متضامن -
تجريد المدين مالم يتفق على غير ذلك .
