١ - إذا اشتمل التظهير على عبارة " القيمة للضمان " أو " القيمة للرهن " أو أى بيان آخر يفيد الرهن جاز للحامل استعمال جميع الحقوق الناشئة عن الكمبيالة . ومع ذلك إذا ظهر الكمبيالة اعتبر التظهير حاصلا على سبيل التوكيل .
٢ - وليس للملتزمين بالكمبيالة الاحتجاج على الحامل بالدفوع المبنية على علاقاتهم الشخصية بالمظهر مالم يكن قصد الحامل وقت حصوله على الكمبيالة الإضرار بالمدين . وتكون حماية الحامل فى هذا الشأن فى حدود دينه المضمون بالرهن .
