١ - الاعتماد المستندى عقد يتعهد البنك بمقتضاه بفتح اعتماد بناء على طلب أحد عملائه (ويسمى الآمر) لصالح شخص آخر (ويسمى المستفيد) بضمان مستندات تمثل بضاعة منقولة أو معدة للنقل .
٢ - عقد الاعتماد المستندى مستقل عن العقد الذى فتح الاعتماد بسببه ، ويبقى البنك أجنبيا عن هذا العقد .
٣ - تسرى فيما لم يرد فى شأنه نص خاص فى هذا الفرع القواعد الواردة بالأعراف الموحدة للاعتمادات المستندية الصادرة من غرفة التجارة الدولية .
