١ - إذا اتفق على أن يكون النقل بالمجان فلا يكون الناقل الجوى مسئولا إلا إذا أثبت طالب التعويض أن الضرر نشأ عن خطأ صدر من الناقل أو من أحد تابعيه أو وكلائه . وفى هذه الحالة يجوز أيضا للناقل الجوى أو لتابعيه أو لوكيله التمسك بتحديد المسئولية وفقا للمادة ٢٩٢ من هذا القانون .
٢ - يكون النقل مجانيا إذا كان بدون أجرة ولم يكن الناقل محترفا النقل . فإذا كان محترفا اعتبر النقل غير مجانى ولو كان بغير أجرة .
