يجوز لورثة الراكب وللأشخاص الذين يعولهم تنفيذا لالتزام بالنفقة ، إقامة دعوى
المسئولية على الناقل لمطالبته بالتعويض عن الضرر الذى أصاب مورثهم أو عائلهم سواء
وقعت الوفاة إثر الحادث مباشرة أو بعد انقضاء فترة زمنية من وقوعه .
