للوكيل أن يمتنع عن إجراء العمل المعهود به إليه إذا كان إجراؤه يتطلب مصاريف غير عادية ولم يرسلها إليه الموكل ، إلا إذا اتفق أو جرى التعامل السابق بين الطرفين على أن يؤدى الوكيل هذه المصاريف .
