١ - إذا أعطيت الوكالة التجارية مطلقة فلا تنصرف إلا إلى المعاملات التجارية .
٢ - وإذا أعطيت الوكالة التجارية مخصصة بمعاملة تجارية معينة جاز للوكيل القيام بجميع الأعمال اللازمة لإجراء هذه المعاملة دون حاجة إلى إذن من الموكل .
