١ - يكون مستثمر المستودع مسئولا عن حفظ البضاعة المودعة وصيانتها بما لا يجاوز قيمتها التى قدرها المودع .
٢ - ولا يسأل مستثمر المستودع عما يلحق بالبضاعة من هلاك أو تلف أو نقص إذا نشأ ذلك عن قوة قاهرة أو طبيعة البضاعة أو عيب ذاتى فيها أو فى كيفية تعبئتها أو حزمها .
