يسقط حق المحامى فى مطالبة موكله أو ورثته بالأتعاب عند عدم وجود اتفاق كتابى بشأنها بمضى خمس سنوات من تاريخ انتهاء الوكالة أو من تاريخ وفاة الموكل حسب الأحوال . وتنقطع هذه المدة بالمطالبة بها بكتاب موصى عليه .
