يلتزم المحامى بأن يدافع عن المصالح التى تعهد اليه بكفاية وأن يبذل فى ذلك غاية جهده وعنايته .
ولا يجوز له النكوص عن الدفاع عن متهم فى دعوى جنائية إلا اذا استشعر أنه لن يستطيع بسبب ظروفه أو ملابسات الدعوى أن يؤدى واجب الدفاع فيها بأمانة وكفاية .
