للمحامى أن يسلك الطريقة التى يراها ناجحة طبقا لأصول المهنة فى الدفاع عن موكله ولا يكون مسئولا عما يورده فى مرافعته الشفوية أو فى مذكراته المكتوبة مما يستلزمه حق الدفاع ، وذلك مع عدم الاخلال بأحكام قانون الاجراءات الجنائية وقانون المرافعات المدنية والتجارية .
