يشترط فيمن يرشح نفسه نقيبا أن يكون من المحامين أصحاب المكاتب الخاصة والمقيدين أمام محكمة النقض والذين أمضوا فى الاشتغال الفعلى بالمهنة أكثر من عشرين سنة متصلة بالاضافة الى الشروط العامة للترشيح لعضوية مجلس النقابة .
