لا تقبل المعارضة فى صرف المبالغ المودعة إلى صاحب الدفتر أو إلى أحد المستحقين عنه أو إلى من يمثلهما إلا إذا كان طالب الصرف ممن لا تتوافر فيه الأهلية أو كان محكوما بغيبته. وفى هاتين الحالتين تسرى أحكام المادتين ٤٣، ٧٨ من القانون رقم ١١٩ لسنة ١٩٥٢ بأحكام الولاية على المال.
