لا يجوز أن يكون عضوا فى مجلس ادارة أية شركة مساهمة ، من حكم عليه بعقوبة جنائية أو عقوبة جنحة عن سرقة أو نصب أو خيانة أمانة أو تزوير او تفالس أو بعقوبة من العقوبات المنصوص عليها فى المواد ١٦٢ ، ١٦٣ ، ١٦٤ من هذا القانون
