فى الأحوال التى يجوز فيها القبض قانونا على المتهم يجوز لمأمور الضبط القضائى أن يفتشه .
وإذا كان المتهم أنثى ، وجب أن يكون التفتيش بمعرفة أنثى يندبها لذلك مأمور الضبط القضائى .
