إذا اشتملت أسباب الحكم على خطأ فى القانون أو إذا وقع خطأ فى ذكر نصوصه ، فلا يجوز نقض الحكم متى كانت العقوبة المحكوم بها مقررة فى القانون لجريمة ، وتصحح المحكمة الخطأ الذى وقع .
