يسقط الاستئناف المرفوع من المحكوم عليه بعقوبة مقيدة للحرية واجبة
النفاذ إذا لم يتقدم للتنفيذ قبل الجلسة التي تنظر فيها الدعوى .
ومع ذلك فللمحكمة عند نظر الاستئناف أن تأمر بوقف تنفيذ العقوبة مؤقتا أو الإفراج
عن المحكوم عليه بكفالة أو بغيرها ، وذلك إلى حين الفصل في الاستئناف .
